Note: the words "we", "our" and "us" in this "Terms and Conditions" document relate to Steve Parish Publishing Pty Ltd, its officers and employees. The word "you" relates to the user of the site.

This Terms and Conditions document governs the use of Photograph Australia Online Service (the Service) including shopping and participation in promotions run by Steve Parish Publishing Pty Ltd. This Agreement can be accessed at any time from the customer care selection on the site menu.

SHOPPING TERMS AND CONDITIONS

Purchasing from photographaustralia.com.au. Photograph Australia purchasing gives customers convenient, quick, easy and secure shopping. Products displayed on the site shopping areas can be purchased using secure online Mastercard, Visa and BankCard transaction facility. Customers can be confident that all of their details are protected by the latest security mechanisms and are used only for purposes of the transaction fulfilment.

PRICING

(a) General
All prices within the Photograph Australia website are in Australia dollars (AUD$). Sales within Australia include an Australian Goods and Services Tax (GST) of 10%. Sales outside Australia exclude Australian Goods and Services Tax (GST) of 10%. There is a foreign currency converter which will allow our overseas customers to view indicative prices in their own currency, less Australian GST. However, the prices converted to your local currency by our foreign currency converter will be an estimate only and the actual prices charged by your financial institution may vary according to changes in the foreign exchange rates. We ahve no control over the foreign exchange rates set by financial institutions and bear no responsibility for the foreign exchange conversion used by these financial institutions. All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.

(b) Purchases Within Australia
You, the purchaser, will be responsible for all freight and insurance, stamp duty, government charges and other duties and taxes that may be levied.

(c) Purchases Outside Australia
You, the purchaser, will be responsible for international freight and insurance charges and any other import duties, taxes and charges which may be levied in the country of destination. Should you fail to pay these relevant import duties and taxes to the freight company on request, then we will charge any unpaid duties , taxes and charges to your credit card account.

SECURITY

It is natural for those new to electronic purchasing to be concerned about security of personal and credit card details. In reality, a commerce transaction on the Internet is significantly more secure than a similar telephone transaction or handing your credit card over the counter in a store.

Even if this unlikely event does occur, we do not keep a record of your full credit card number. Only authorised personnel from the Photograph Australia site administration and our hosting provider, are allowed either physical or electronic access to the web server or databases.

Steve Parish Publishing Pty Ltd has a strong privacy policy relating to all information provided to us through this web site and we take all reasonable steps to prevent any data being inappropriately released or misused.

RETURNS

We are committed to providing quality products to our customers. However, if you do receive a product which is faulty or damaged, we must receive your written claim within 14 days of your receipt of the product. If the claim for exchange or refund is authorised by a Company representative then the goods must not have been marked or used and the following details must accompany the product returned: the invoice number, your name and address. You may obtain returns authorisation by contacting our Customer Service Department by email, fax (61 7 3278 6311) or telephone on (61 7 3278 6511).

LEGAL WARRANTIES AND LIMITATIONS

You acknowledge that:

(a) to the full extent permitted by law all express and implied terms, conditions and warranties other than the ones set out in these terms are excluded.
(b) you may have the benefit of conditions and warranties implied by the Trade Practices Act 1974 to the extent permitted by law. If we have a liability for breaching a condition or warranty implied by Division 2 of Part V of that Act (other than section 69), it is limited, subject to section 68A(2), at our discretion to:

(i) replacing or repairing the Goods, or paying for their replacement or repair:
(ii) supplying equivalent Goods, or paying for their supply.

(i) the possession, operation or use of the Goods or any items supplied with them;
(ii) any act or omission (including negligent acts or omissions) of us or our employees or agents.

(d) you will indemnify us against any claims made against us by any third party concerning death, injury, loss or damage as set out in subparagraph (c) above.
(e) You will indemnify us against all losses and expenses we may incur due to your failure to observe your obligations under these terms.

(a) If preparing your order for delivery or the delivery of the Goods is suspended by your instructions or lack of instructions, the price will be increased to recover any extra expenses we incur.
(b) If you cancel the order before delivery but after the Goods are ready for dispatch, we reserve the right to invoice you and charge for all expenses involved in preparing your order for delivery.
(c) If you cancel the order before delivery but after the Goods are ready for dispatch, we reserve the right to charge you for all expenses incurred to that stage.

MATTERS BEYOND OUR CONTROL

We will not be responsible for non-delivery or delay in delivery of the goods caused by any matter beyond our reasonable control, even if that matter exists at the time you agree to these terms. We may deliver those goods at our option at any subsequent time and you will accept them.

GOVERNING LAW

The laws of Queensland, Australia govern these terms and conditions and we and you accept the exclusive jurisdiction of the Queensland Courts in any dispute between us.

Should any of these terms and conditions be void or unlawful, these terms and conditions shall be read and enforced as if the void or unlawful term had been deleted.
